Former MP Sanjay Kakade | Former MP Sanjay Kakade’s problems increase: Bombay HC issues order that shares of Kakade Construction Company should be sold

Pune: A non-bailable warrant (NBW) has been issued against former MP Sanjay Kakade for not adhering to an order issued by the National Consumer Disputes Redressal Commission (NCDRC).

In its order, the NCDRC had directed him to refund the booking amount with 9 pc interest given by the complainant. After booking a flat in one of his projects, Kakade’s company neither signed an agreement nor started constructing the building.

NCDRC President Justice Ram Surat Maurya and Member Bharatkumar Pandya gave this direction. Anagha Ambetkar, a resident of Kothrud, filed a complaint against Kakade Construction Company Pvt Ltd. The complainant booked a flat in the Kothrud Baug project of the company in 2015. She paid to the company from November 10, 2015 over Rs 21.34 lakh from time to time for the purchase of a flat, which cost Rs 99.73 lakh. However, the company did not sign an agreement for sale with her. It also did not start construction as per the schedule. Therefore, the complainant cancelled her booking in June 2017 and demanded a refund of her money.

Initially, the company paid her Rs 5 lakh. The complainant had prayed before the commission for its direction to pay the remaining amount. A hearing was conducted and the company was directed to refund over Rs 16.34 lakh with 9 pc interest from the date of booking. The company was also directed to pay the litigation charges of Rs 50,000. The direction was given in February 2023.

Since the complainant was not refunded her money as per the commission’s order. She filed an application through her legal counsel Adv Dnyanraj Sant before the NCDRC. The direction was given over a year ago. The company was given three opportunities to comply with the order. However, the company did not follow the order. Therefore, Adv Dnyanraj Sant sought the NBW against Kakade.
