FIR Filed Against Actor Rhea Chakraborty But Why CBI Can’t Investigate The Case In Mumbai?

Mumbai: The Central Bureau of Investigation (CBI) has filed an FIR against actor Rhea Chakraborty for abetting the suicide of actor Sushant Singh Rajput. However, the probe agency will not be able to investigate the case in Mumbai and in other places in Maharashtra.
Bihar Chief Minister Nitish Kumar, on the request of Sushant’s family, handed over the case to CBI which is currently being probed by the Patna Police.The anti-corruption unit Vl of CBI has been tasked to investigate the case. The probe team will be headed by Joint Director Manoj Sashidhar (IPS, Gujrat Cadre). DIG Gagandeep Ghambir will supervise the probe whereas Anil Yadav, additional superintendent of police will be the investigation officer.
Bihar government had issued a notification on  Tuesday read, “The Governor of Bihar is pleased to accord his consent to exercise of powers and jurisdiction to the whole of Bihar and other places related to the case to the members of Delhi Special Police Establishment to Investigative and enquire into the case related to the death of Bollywood actor Sushant Singh Rajput.”
Though the Bihar government has given their consent for the entire state and other places related to the crime. But if the probe agency is outside Bihar, the CBI will again require consent from the respective states to investigate in the state jurisdiction.
The CBI will take over documents from Bihar Police, however, they may wait for Supreme Court to give a clear order or direction so that they can initiate the probe in Mumbai too.CBI has general consent from Maharashtra but as this case will be probed by Special Crime Unit of CBI, separate consent will be required for CBI to investigate from the Maharashtra government.
Only if Maharashtra gives similar territorial jurisdiction consent for CBI as Bihar has given, the agency can enter Maharashtra and probe this case. However, if the Supreme Court orders a CBI investigation, the federal probe will not require any permission from any state.
