New Delhi, Policenama Online – The last door to escape the death sentence of Mukesh Singh, a criminal of Nirbhaya, has also closed. The Supreme Court upheld the President’s decision, dismissing Mukesh’s petition challenging the President’s decision to reject the mercy petition.
A three-judge bench headed by Justice R Bhanumati said, “The President’s early consideration of the mercy petition and immediately rejecting it does not mean that he did not use his discretion or that it was motivated by prejudice.”
In its 25-page judgment, the bench said, “All documents including the past criminal history of the convicts, economic status of their families and judgment given by the courts were brought before the President for consideration before consideration of mercy petition”.
At the same time, now another convict Akshay Thakur has given a curative petition in the Supreme Court, three days before the date of hanging on February 1, on which the bench of five judges will hear on Thursday.
Earlier, while hearing Mukesh’s plea, a bench of Justices Bhanumathi, Justice Ashok Bhushan and Justice AS Bopanna said in its 25-page judgment, the Ministry of Home Affairs submitted all the documents in sealed cover from the Delhi government on 15 January which were placed before the President for consideration.
It also included the decisions of the lower court, the High Court and the Supreme Court. The alleged torture in prison cannot be the basis for judicial review of executive decisions passed under Article 72 of the Constitution.
In some cases under this Article, the President is empowered to pardon and keep the sentence pending, waived or reduce it. As a result, we find no basis for judicial review of the President’s decision to dismiss Mukesh’s mercy petition. This petition is eligible to be dismissed.

Nirbhaya’s mother said, “I welcome the decision of the Supreme Court and want all the culprits to be hanged at the earliest. I have maintained faith in the law for the last seven years and still stand. We have went one step further. The verdict grew closer. I expect that they will soon be hanged on February 1. They will play legal games until they are hanged. The Supreme Court should give justice to my daughter at the earliest.”
